Ratio Decidendi

The court found that the petitioner failed to disclose all beneficiaries of the deceased's estate and filed the petition without their knowledge, thereby disinheriting them. The deceased died intestate, without spouse or children, and his brothers, including both the petitioner and objector, are entitled to share the estate equally under section 39 of the Law of Succession Act. The grant was therefore obtained in a manner contrary to the law, justifying its revocation under section 76. The court exercised its inherent powers to appoint both the petitioner and objector as co-administrators and directed that a proposal for distribution among all beneficiaries be filed.
