The court held that the Law of Succession Act does not permit substitution of a deceased administrator by way of rectification or amendment of the grant or certificate of confirmation. Grants are issued in personam and cannot be transferred to another person upon the death of an administrator. The proper procedure, where an administrator dies, is for the surviving administrators to continue if any remain; if all have died, the grant becomes inoperative and must be revoked under section 76(e) of the Act, after which a new grant may be issued to new administrators.
