The court held that the dismissal was due to inadvertence and not deliberate inaction or obstruction. Given the threat of intermeddling with the estate and the need to include all beneficiaries, the court exercised its discretion to set aside the dismissal order and reinstate the succession cause for hearing on its merits, in the interest of justice.
