The court found that the applicants, as confirmed administrators of the estate of Daniel Kuria Mutuura (deceased), are entitled to be substituted in place of Daniel in the confirmed grant for the estate of Andrew Mutuura Kuria, so that the properties due to Daniel devolve to his estate. However, in respect of property LR No.12167/134, which is alleged to have been sold to third parties, the court held that the interests of those third parties must be protected by notifying them of the proceedings before any orders affecting their interests are made.
