Procedural Posture

Succession Cause / Ruling on Application for Revocation of Grant

  1. 1 Whether the grant of letters of administration was obtained fraudulently by concealment of material facts.
  2. 2 Whether the applicant was a wife of the deceased and entitled to a share of the estate.
  3. 3 Whether the respondents failed to involve the applicant in the succession proceedings.

Ratio Decidendi

The court found that the applicant had established sufficient grounds for revocation of the grant. The evidence showed that she was a wife of the deceased, had lived on the disputed land with her children since 1984, and was not involved in the succession proceedings initiated by the respondents. The respondents failed to challenge these averments. The court held that the grant was obtained without disclosure of all beneficiaries, amounting to concealment of material facts, and that the subsequent transfer of the land was improper. Accordingly, the grant was revoked and the title to the land ordered to revert to the deceased's name.
