The court found that although the amalgamation and subdivision of the estate's main land assets were conducted before confirmation of grant, the process was done openly with the knowledge and consent of both houses and the clan, resulting in an equal division of 19 acres to each house. There was no evidence of fraud or malafide intent in the subdivision. The properties LOC Rwathia 3145-3156 were determined to have been gifted inter vivos to the wives and thus did not form part of the estate.
