The court held that the trial magistrate erred in law by entertaining the respondent's application dated 4th June, 2014 after the grant had already been confirmed. The Law of Succession Act expressly prohibits such applications for provision for dependants once a grant has been confirmed, and the only available remedy would have been to seek revocation or annulment of the grant. Furthermore, the respondent was not a dependant of Gathiga Gacago Mathigi but of Reuben Mwangi Gathiga, and any claim should have been pursued in a separate succession cause for Reuben Mwangi's estate.
