Ratio Decidendi

The court found that there was insufficient evidence to establish that the deceased made a valid gift of Syokimau farm to Joyce Mathei Nziuko, either as a gift inter vivos or a gift in contemplation of death. The requirements for a valid gift mortis causa under section 31 of the Law of Succession Act were not met, as there was no evidence of the deceased contemplating death at the time of the alleged gift, nor was there delivery of possession or title. The alleged gift inter vivos was also incomplete, as there was no written instrument or transfer, and the property remained registered in the deceased's name. Furthermore, the beneficiaries' mother could not gift property she did not own....
