Procedural Posture

Probate and Administration / Ruling on Application for Police Security During Execution of Court Orders

  1. 1 Whether the Petitioners are entitled to orders for police security during execution of court orders regarding the estate.
  2. 2 Whether there exists any legal impediment to the execution of the court's orders issued on 24th December, 2024.

Ratio Decidendi

The court found that the Petitioners, as confirmed administrators, are entitled to execute their duties in administering and subdividing the estate, as there is no legal impediment or stay of execution in place. The Objectors failed to comply with prior court orders and did not provide evidence of a valid pending appeal or stay. The belated introduction of a purported Will was deemed unconvincing and procedurally improper at this stage. The court exercised its powers under the Law of Succession Act to facilitate the administration of the estate and ordered police security to ensure compliance with its orders, with costs and facilitation expenses to be borne by the estate.

Court Disposition

Application allowed. Orders granted for police security during execution of court orders; costs and facilitation expenses to be met by the estate.

Orders
