Ratio Decidendi

The court found that there was no error apparent on the face of the ruling dated 20/03/2014 to warrant a review, as the relisting of prayers and the consent entered into by the parties had already resolved the issues raised by the protestor. The protestor's delay in seeking review was inordinate and unjustified. Regarding the application for rectification and substitution of the deceased administrator, the court held that the death of a joint administrator rendered the grant inoperative by operation of law, and the only lawful remedy was revocation of the grant under section 76 of the Law of Succession Act. The attempt to substitute another person as administrator was therefore rejected....
