The court held that pension proceeds payable to the widow under the Pensions Act are not part of the deceased's estate and cannot be assigned or distributed to the deceased's children, all of whom are above 21 years of age and thus not eligible under the Act. The widow's earlier waiver or willingness to cede the pension could not override the express statutory provisions, and the doctrine of estoppel was inapplicable where it would contravene clear legal requirements. The inclusion of Schedule C in the rectified grant, which disinherited the deceased's children from inheriting from the widow, was contrary to the Law of Succession Act, and the court ordered its deletion.
