Ratio Decidendi

The application to declare the lapse of the orders issued on 14th July, 2022 and to vacate the prohibition order on the suit property has been overtaken by events. The Court of Appeal, in Nakuru Civil Application No. E043 of 2024, has directed that the status quo be maintained pending the hearing and determination of the appeal (No. E030 of 2022). As such, the High Court is functus officio and lacks jurisdiction to vary or vacate orders relating to the subject matter now under the appellate court's consideration. The application is therefore moot, and no further orders are warranted at this stage.
