The court found that the grant of Letters of Administration intestate issued to the deceased petitioner Esther Chepkemoi Rugut became inoperative and useless upon her death before the completion of the succession proceedings. In accordance with Section 76(e) of the Law of Succession Act and relevant case law, the proper procedure is to revoke the existing grant and issue a fresh grant de bonis non to a qualified beneficiary. The applicant, being a surviving immediate beneficiary with the consent of her sister, was found to have priority to administer the estate.
