Procedural Posture

Succession Cause / Ruling on Summons for Revocation of Grant

  1. 1 Whether the applicant proved purchase of a portion of the deceased's land from the estate.
  2. 2 Whether the applicant is entitled to revocation of the grant for being left out of the distribution.
  3. 3 Whether the applicant is protected as an innocent purchaser under Section 93 of the Law of Succession Act.

Ratio Decidendi

The court found that the applicant failed to provide any documentary evidence or annexures to support his claim of purchase of the suit property from the deceased. There was no proof of transfer of the land to the applicant, nor evidence of uninterrupted occupation. The applicant also did not contest the respondent's assertion that his wife, the 3rd respondent, had her interest addressed in the grant. Consequently, the applicant could not benefit from the statutory protection for innocent purchasers under Section 93 of the Law of Succession Act. The absence of evidence led the court to dismiss the application for revocation of the grant.

Court Disposition

Orders

  • The application for revocation of grant is dismissed.
