Ratio Decidendi

The court held that the stay order issued on 19th January 2016 had lapsed after 90 days, and there was no subsisting order to set aside. The respondents' claims as purchasers had already been placed before the Environment and Land Court, which is the appropriate forum for such disputes. The succession proceedings could not be indefinitely stayed pending the outcome of the Environment and Land Court case, as the function of the succession court is to transmit the estate to the beneficiaries. The Applicant was therefore entitled to proceed with confirmation of grant and distribution of the estate as per the beneficiaries' consent, with the Environment and Land Court retaining jurisdiction...
