Procedural Posture

Succession Cause / Ruling on Application for Leave to Appeal and Stay of Execution

  1. 1 Whether the applicant should be granted leave to appeal the ruling delivered on 20th December, 2023.
  2. 2 Whether a stay of execution of the Certificate of Confirmation of Grant should be granted.

Ratio Decidendi

The court found that, although the Law of Succession Act does not provide an automatic right of appeal from the High Court to the Court of Appeal in succession matters, such an appeal may be filed with leave of the court. The applicant demonstrated dissatisfaction with the distribution of the estate, and in the interest of justice, leave to appeal was granted. However, the respondent established that the Certificate of Confirmation of Grant had already been executed and title deeds issued, rendering any stay of execution impossible and futile. The court emphasized that it should not make orders in vain and thus declined to grant a stay of execution.

Court Disposition

Leave to appeal granted; stay of execution refused.
