The court found that Nyandarua/Ol-joro-Orok Salient 1828 had been subdivided and transferred to third parties before the deceased's death, and thus did not form part of the estate available for distribution. The only properties available for distribution were Baringo/Ravine/102/74 and LR NO.448/12. There was insufficient evidence that the deceased had conclusively expressed and actualized his wishes regarding the settlement of his three houses. Accordingly, the court applied Section 40 of the Law of Succession Act, requiring equitable distribution among the three houses, with each house treated as a unit and the surviving widow as an extra unit.
