Procedural Posture
Succession Cause / Ruling on Closure After Annulment of Grant
Legal Issues
- 1 Whether the matter is concluded following the annulment of the grant of letters of administration and absence of further applications.
- 2 Whether the file should be closed in the absence of any pending matters.
Ratio Decidendi
The court found that, following the annulment of the grant of letters of administration intestate and the failure of the parties to reach a settlement, there were no pending matters for consideration. In the absence of any further applications, the succession cause is concluded and the file is to be closed, subject to reopening only if a new application is filed. This approach upholds the finality of court decisions in succession proceedings where no further contest or application remains.
Court Disposition
Matter concluded; file closed unless a new application is filed.
Orders
- The matter is concluded and the file reverts to the Registry.
- Unless and until any other application is filed, the file is technically closed.

Ruling
1. The court delivered a ruling in this matter on 23rd May, 2023 in which the letters of Administration Intestate issued and subsequently confirmed were annulled as prayed. The parties were advised to petition for letters of Administration Intestate afresh or negotiate the settlement of the matter.
2. On 30th November 2023, the court was informed that there no agreed settlement on the matter. The matter was left to the court. Having rendered its decision on the application for annulment or revocation, there is no other pending matter for consideration. The matter is thus concluded. The file reverts back to the Registry, and unless and until any other application is filed, the file is technically closed.
3. It is so ordered.
