Procedural Posture

Succession Cause / Ruling on Application to Join as Interested Party and for Revocation of Grant

  1. 1 Whether the applicant is entitled to be joined as an interested party in the succession proceedings.
  2. 2 Whether the applicant is a creditor to the estate of the deceased.
  3. 3 Whether the applicant is entitled to revocation of the grant issued on 14th May 2018.

Ratio Decidendi

The court found that the applicant had no direct connection with the deceased, as the transaction for the land was between the applicant and a beneficiary, not the estate itself. Consequently, the applicant could not be considered a creditor of the estate and had no standing to seek revocation of the grant or to be joined as an interested party in the succession proceedings. Furthermore, the court held that the issues raised by the applicant regarding the land transaction were outside the jurisdiction of the succession court and should be addressed in the Environment and Land Court. The application was therefore dismissed.
