Ratio Decidendi

The court found that the existence of a prior confirmed grant in Succession Cause No. 128 of 2001 precluded the issuance of a subsequent grant in respect of the same estate. Section 6 of the Civil Procedure Act prohibits the court from proceeding with a suit where the matter is already directly or substantially in issue in a previously instituted suit between the same parties. The subsequent grant issued in the present cause was therefore a nullity. The proper course for the petitioners, if aggrieved by the prior grant, was to seek revocation or annulment of that grant under section 76 of the Law of Succession Act, not to initiate a parallel succession cause.
