Procedural Posture
Succession Cause / Ruling on Summons for Extension of Time and Grant of Letters of Administration
Legal Issues
- 1 Whether the applicant should be granted an extension of time to file the petition for letters of administration beyond the period previously ordered by the court.
- 2 Whether the applicant should be issued with a grant of letters of administration for the estate of the deceased.
Ratio Decidendi
Despite the applicant's failure to provide a satisfactory explanation for the delay and the lack of supporting affidavit, the court exercised its discretion in the interests of justice and the need to administer the estate. The court found that, as a family matter, the estate must be dealt with, and thus allowed the application, granting the applicant a further 30 days to comply with the previous orders for filing the petition for letters of administration. The court emphasized the importance of compliance with its orders but prioritized the administration of the estate over procedural lapses, especially in the absence of opposition.
Court Disposition
application allowed
Orders
- The applicant is granted 30 days from the date of the ruling to comply with the orders of 27th September 2018.
