Procedural Posture

Succession Cause / Ruling on Summons for Revocation or Annulment of Grant

  1. 1 Whether the applicant was the husband or dependant of the deceased.
  2. 2 If the applicant was a husband or dependant, whether the grant was obtained by fraud, deceit, or concealment of material fact.
  3. 3 Whether the grant should be revoked.

Ratio Decidendi

The applicant failed to prove, on a balance of probabilities, that he was married to the deceased under Luo Customary Law or that he was a dependant of the deceased. The court found no evidence of customary marriage, such as consent from the deceased's parents or payment of dowry, nor any supporting affidavits from relatives. The applicant's reliance on his own affidavits and birth certificates of the children was insufficient to establish marriage or dependency. The fact that the deceased was buried at her late husband's home further undermined the applicant's claim. Consequently, the applicant lacked standing to challenge the grant, rendering the application for revocation without merit.
