The court found that the deceased died in 1964, before the commencement of the Law of Succession Act, and thus the distribution of his estate is governed by Kikuyu customary law. Under this law, a married sister has no right to inherit her brother's estate, and the estate should have devolved to the father or, in his absence, to the deceased's brothers. The 1st respondent obtained the grant by concealing the existence of other siblings and the deceased's parents, and by making false statements to the court.
