Ratio Decidendi

The court found that the applicants sought to alter the substantive distribution of the estate by increasing the acreage allocated to them, which is not permitted under the rectification provisions of section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules. The power of rectification is limited to correcting clerical errors or misdescriptions, not to effecting substantive changes to the confirmed grant. Since the proposed amendments would substantially affect the grant, the proper procedure would be to seek review or appeal, not rectification. The court, being functus officio after confirmation of the grant, dismissed the application for rectification.
