As such, the property could not be treated as part of the deceased's general estate for distribution among all beneficiaries. The trial magistrate erred by including the trust property in the estate distribution and disregarding the ELC's binding declaration. The probate court lacks jurisdiction to override or revisit trust declarations made by the ELC. Consequently, the Mahiga property must be allocated solely to the 1st house, and only the Bellevue property remains available for distribution...
