Procedural Posture

Succession Cause / Judgment

  1. 1 Whether the applicant's mother was a lawful wife of the deceased for purposes of succession.
  2. 2 Whether the applicant and his family were entitled to be recognized as beneficiaries of the deceased's estate.
  3. 3 Whether the prior court decision on the applicant's mother's marital status is binding and conclusive in these proceedings.

Ratio Decidendi

The court found that the issue of whether the applicant's mother was a lawful wife of the deceased had already been conclusively determined in Thika CMCCC No. 2 of 1999, where it was held that she was not married to the deceased. The appeal against that decision was withdrawn, and the ruling remains valid and binding. As such, the matter is res judicata and cannot be revisited in the present proceedings. Consequently, the applicant and his family cannot be recognized as beneficiaries of the deceased's estate, and the application for revocation of the grant lacks merit. The court dismissed the application and directed the administrators to proceed with the confirmation of the grant.

Court Disposition
