The court found that the respondents, as petitioners in Nyeri Succession Cause 455 of 2009, were aware that the estate of Truphena Wambui Munyori could only be distributed after the conclusion of the succession cause for her husband, Rufus Munyori Matha, in Nairobi High Court Succession Cause No. 1509 of 2001. The grant issued on 9th October 2009 was therefore obtained without disclosure of the ongoing Nairobi cause, a material fact that would have affected the court’s decision to issue the grant.
