Procedural Posture

Succession Cause / Ruling on Application for Authorization to Sign Transmission Documents and Provision of Security During Subdivision

  1. 1 Whether the court should authorize the Deputy Registrar to sign transmission documents on behalf of the 2nd Administrator who has declined to do so.
  2. 2 Whether the OCS Githongo should be directed to provide security during the subdivision of the estate.

Ratio Decidendi

The court found that the 2nd Administrator's refusal to sign the transmission documents constituted a breach of his statutory duties under the Law of Succession Act and was prejudicial to the beneficiaries awaiting their rightful shares. To prevent further delay in a matter pending for 35 years, the court exercised its discretion to authorize the Deputy Registrar to sign the necessary documents if the 2nd Administrator failed to do so within seven days. The court also directed the OCS Githongo to provide security during the subdivision to ensure the process was not disrupted, thereby facilitating the final distribution of the estate.

Court Disposition

Application allowed with conditions.

Orders

  • If the 2nd Administrator declines to sign the transmission forms within 7 days of presentation, the Deputy Registrar is authorized to sign all necessary transmission documents on his behalf.
  • The OCS Githongo Police Station is directed to provide security on the date scheduled for subdivision of the deceased’s estate.
