Ratio Decidendi

Neither the applicants nor the respondents have been issued with a grant of representation and therefore none has legal authority to deal with the estate of the deceased. Both sides have engaged in acts amounting to intermeddling, which is prohibited by law. The court must act to prevent further intermeddling and wastage of the estate pending the issuance of a grant. Accordingly, the court issues a temporary injunction restraining all parties from interfering with the estate assets and directs that all rental income be deposited into a joint interest-earning account in the names of the advocates for the applicants and the respondent.   • A temporary injunction is issued against both the applicants and the respondents, their agents, personal representatives, and/or agents from interfering with the properties and assets comprising the estate of the deceased pending the issuance of a grant of letters of administration.
  • All rental income derived from assets comprising the estate of the deceased shall from the date of this ruling be deposited into a joint interest earning account opened in the name of the advocates for the applicants and the respondent Serah Wanjiru Muthoni.
