Ratio Decidendi

The court found that its previous order directed that the Ad Litem grant should issue to the person granted custody of the minor in Kisumu Children’s Court Case No. 19 of 2015. Since custody and full parental rights had now been granted to the applicant by a subsequent order, it followed that the Ad Litem grant should be re-issued to him. The court therefore reviewed and set aside its earlier order granting the Ad Litem grant to Agape Children’s Ministry and directed that the grant be issued to the applicant.
