The proceedings were therefore defective in substance. The applicant established sufficient grounds under Section 76 of the Law of Succession Act for revocation of the grant. The application was unopposed, and the court held that the interests of justice required revocation of the confirmed grant, appointment of the applicant as co-administrator, and a fresh application for confirmation of grant to ensure all beneficiaries are considered.
