No oral or concrete evidence was presented to support the claim that the deceased was not of sound mind. The court further held that its discretion under Section 26 of the Law of Succession Act to make reasonable provision for dependants can only be exercised upon a formal application, which was not made in this case. The objection proceedings were limited to the propriety of making a grant and not to the adequacy of provision for dependants.
