Since two of the deceased’s daughters had renounced their claims, the estate should be distributed between the applicant and the children of Mary Ngonyo, deceased. The court applied the Law of Succession Act, ordering that the disputed parcel of land be subdivided into two equal portions: one for Grace Waititu Mwangi and the other for Ngonyo Githemo and Migwi Ngonyo as beneficiaries of Mary Ngonyo. Each party was to bear their own costs.
