Ratio Decidendi

The court held that the death of a sole administrator renders the grant of representation useless and inoperative, as grants are made in personam and are not transferable. The Law of Succession Act does not provide for substitution of a deceased administrator through review; instead, the proper legal procedure is to apply for revocation or annulment of the grant under section 76(e) of the Act and then seek a fresh grant. The applicant's request for substitution by way of review was therefore untenable, and the application was dismissed. The applicant was advised to apply for revocation of the grant and subsequently seek appointment as administrator in accordance with the statutory procedure.
