The High Court found that the trial court fundamentally erred by converting a succession cause into an ordinary civil suit and applying the Civil Procedure Act and Rules, contrary to the Law of Succession Act and the Probate and Administration Rules. The only Civil Procedure Rules applicable in succession matters are those specified in Rule 63 of the Probate and Administration Rules. The trial court's adoption of procedures outside this framework rendered the proceedings and resulting judgment null and void ab initio.
