The court found that the deceased, despite his illness, remained lucid and of sound mind at the time of making the oral will, as evidenced by the consistent testimonies of the applicant and Margaret Wanjiku Gathiomi, who cared for him in his final days. The objectors failed to provide medical or other credible evidence to rebut the presumption of testamentary capacity. The oral will was validly made and acknowledged before two competent witnesses on 26th December 2017, two days before the deceased’s death, satisfying the requirements of Section 9 of the Law of Succession Act.
