The court held that the applicant, having filed the application before obtaining a grant of representation, lacked the legal competence to seek orders restraining the respondents from intermeddling with the estate. The Law of Succession Act requires that only a person with a grant of representation can bring such actions. Although the court has inherent powers under section 47, these must be exercised within the law, and the applicant's remedy prior to obtaining a grant was to report the alleged intermeddling to the police under section 45. As the application was filed before the grant was issued, it was incompetent and could not be entertained by the court.
