Procedural Posture

Succession Cause / Ruling on Application for Reinstatement and Setting Aside of Revocation Orders

  1. 1 Whether the orders revoking the grant of letters of administration intestate and dismissing the cause for want of prosecution should be set aside.
  2. 2 Whether the cause should be reinstated to allow the applicants to file summons for confirmation of grant.

Ratio Decidendi

The court found that the notices to show cause for dismissal were issued in error because the grant of letters of administration intestate had already been confirmed in 2017, and the cause was effectively concluded. There was no pending application for confirmation of grant at the time the notices were issued. The orders revoking the grant and dismissing the cause were therefore improper and must be set aside. The court clarified that the only remaining step is for the administrators to prepare a certificate of confirmation of grant and comply with the distribution orders already issued. The application for reinstatement was unnecessary, and the court moved suo moto to correct the record...

Court Disposition

Application dismissed as unnecessary; court sets aside erroneous dismissal and revocation orders suo moto.
