Ratio Decidendi

The court found that the applicant did not comply with the mandatory statutory requirements under Sections 16 and 16A of the Births and Deaths Registration Act for registering the death of a Kenyan citizen who died outside Kenya. The applicant failed to provide evidence from the appropriate Tanzanian authority or other prescribed evidence as required by law. The prior order presuming death was not sufficient once the actual date and place of death were known. As such, the Registrar was justified in refusing to issue the death certificate, and the application was dismissed for lack of merit.
