Legal Issues
- 1 Whether the summons for revocation of grant can be determined in the absence of a legible copy of the application and supporting affidavit.
Ratio Decidendi
The court declined to determine the summons for revocation of grant because the copy on record, including the supporting affidavit and annexures, was illegible. The judge directed the applicant to provide a clear copy and urged both parties to review the court file to ensure all necessary documents are legible and, if not, to substitute them with clearer copies. The decision was based on the necessity for clear and accessible documentation to enable the court to adjudicate fairly and effectively.
Court Disposition
No determination on merits; applicant directed to provide clear copy of summons.
Orders
- Applicant to provide a clear copy of the summons for revocation of grant.
- Both parties to review the court file and substitute any illegible filings with clearer copies.

Ruling
1. I am meant to determine a summons for revocation of grant, dated September 29, 2020.
2. The copy of the said summons on record, together with the supporting affidavit and its annexures, is so faint that it is completely illegible.
3. The applicant will have to provide a clear copy.
4. I urge both parties to peruse the court file, to ascertain which of their filings would require substitution with clearer copies.
