Upon considering the merits, the court held that the 1st respondent failed to prove the existence of a valid customary marriage with the deceased, and thus was not a spouse. The deceased's will, which was valid and applicable to his Kenyan estate, had been concealed by the 1st respondent, who knowingly filed for intestate succession despite being aware of the will.
