Procedural Posture
Commercial Case / Ruling on Preliminary Objection/filing Error
Legal Issues
- 1 Whether the court can proceed with an application wrongly filed as a commercial case instead of a succession cause.
- 2 Whether the court has jurisdiction to transfer or handle a misclassified matter in the e-filing system.
Ratio Decidendi
The court determined that it could not entertain or transfer the application dated 5th January 2024 because it was wrongly filed as a commercial case instead of a succession cause. The e-filing system requires strict compliance with case classification, and the court lacks jurisdiction to regularize or transfer such misfiled matters. The only remedy is for the applicant to file a fresh application in the correct forum, specifically in the succession cause file that contains the grant sought to be rectified. As a result, the application was struck out and the file closed.
Court Disposition
application struck out; file closed
Orders
- The application dated 5th January 2024 is struck out.
- The applicant to be notified to file another application in the proper forum and to apply for reopening of the closed succession file.

Ruling
1. As this matter which is a Succession Cause was wrongly filed in the e-filing system by the applicant as a commercial case, the application dated 5th January 2024 cannot be handled as a commercial case since each case is classified differently in the system and this court cannot transfer it unless the party filing refiles the same. The application dated 5th January, 2024 is therefore is struck out.
2. The Applicant to be notified to file another application in the proper forum for consideration and to apply for reopening of the closed succession file which has the grant which is being sought to be rectified.
3. This file is closed.
4. This Ruling to be typed and uploaded on CTS.
