The court found that the grant of probate issued to George Njenga Gikuni had become useless and inoperative due to his death, as a grant is personal to the named executor and cannot be used by anyone else. Under Section 76 of the Law of Succession Act, such a grant must be revoked. The court further held that both Maria Kibinya and Moses Nthenge, as residuary legatees, are equally entitled to be appointed administrators under Sections 63 and 66 of the Law of Succession Act. Since only Maria Kibinya applied and there was no evidence of Moses Nthenge's consent, the law required both to be appointed.
