The court found that the issue of the alleged forged death certificate had already been addressed in a previous ruling and was therefore res judicata. There was no evidence that the Petitioner forged the death certificate, and any error on the date of death could be rectified by a summons for rectification. The court further held that there was no valid oral or written will, and the minutes of 20/2/2000 did not constitute a valid distribution of the estate as gifts intervivos require actual transfer during the deceased's lifetime.
