Ratio Decidendi

The court found, based on the medical report from a consultant psychiatrist at Mathari National Teaching and Referral Hospital, that the subject, EWK, suffers from a mental disorder (dementia and depression) and is incapable of managing her own affairs. The applicants, being her sons and having the consent of all siblings, are suitable persons to be appointed as guardians ad litem. The application was unopposed, and the requirements of the Mental Health Act, Cap 248, were satisfied. The court therefore adjudged EWK to be mentally incapacitated and appointed JMK and JNK as her guardians ad litem, limited to substituting her as the second defendant in Thika ELC No. 247 of 2017.
