The court held that, although the applicant provided medical evidence of Francis Kiprotich Langat's incapacity, the law under Order 32 Rule 15 of the Civil Procedure Rules, 2010 requires a judicial inquiry before a person can be declared incapable of protecting their interests and a next friend appointed.
