Ratio Decidendi

The court found that although the administrators were entitled to petition for the grant after the objector failed to do so, the fatal flaw in the administration was the failure to obtain the consent of all beneficiaries, including the objector, to the mode of distribution. This omission amounted to concealment of material facts and rendered the confirmation of the grant defective. The court therefore revoked the grant and directed that a fresh grant be issued to the same administrators, with instructions that the beneficiaries must agree on the mode of distribution before confirmation. If agreement is not reached, the parties may adduce evidence to resolve the dispute.
