Miscellaneous Application / Ruling on Application for Guardianship and Management of Estate

  1. 1 Whether the subject should be declared as suffering from mental disorder pursuant to the Mental Health Act, Cap 248.
  2. 2 Whether the applicant should be appointed as guardian to the subject as well as manager of the estate of the subject.

Ratio Decidendi

The court found, based on uncontroverted medical evidence and supporting affidavits, that the subject suffers from dementia/Alzheimer's disease and is incapable of managing her affairs. The Mental Health Act empowers the court to declare a person mentally unfit and to appoint a guardian and manager for their estate. The applicant, being the son and only child of the subject, had the support of other family members and no objections were raised. The court concluded that the statutory requirements were met and that the applicant should be appointed as guardian ad litem and manager of the subject's estate, limited to substitution as co-administrator in the relevant succession cause.
