Miscellaneous Application / Judgment

  1. 1 Whether GWK is suffering from a mental disorder within the meaning of Section 26 of the Mental Health Act.
  2. 2 Whether the petitioner LNK should be appointed as guardian and manager of GWK and her estate.
  3. 3 Whether the requirements for appointment of a guardian and manager under the Mental Health Act have been satisfied.

Ratio Decidendi

The court found, based on uncontroverted medical evidence and the observations of the judge, that GWK suffers from dementia and Alzheimer's disease, rendering her incapable of managing her own affairs. The petitioner, LNK, is her biological son and has demonstrated fitness and willingness to act in her best interests. The other children of GWK consented to the petition and raised no objections. The requirements under Section 26 of the Mental Health Act and the guiding principles from RE NMK (2017) eKLR were satisfied. Accordingly, the court declared GWK to be a person suffering from a mental disorder and appointed LNK as her guardian and manager of her estate.
