The court found that the applicants had satisfied all legal requirements for adoption under the Children Act, 2001. The social inquiry reports confirmed their suitability, and the child was found to be happy and well cared for in their custody. The court determined that it was in the best interests of the child to be adopted by the applicants, who would assume all parental rights and obligations. The child, having been born in Kenya to a Kenyan national, was presumed Kenyan by birth. The court therefore granted the adoption, appointed a legal guardian in case of incapacity or death of the applicants, and directed the Registrar-General to enter the adoption in the Adopted Children Register.
